As the new fiscal year approaches, I'd like to once again affirm my commitment to providing a work environment that is free from any form of discrimination or   harassment.

All Fiscal Service employees, contractors, and applicants are  protected under the laws prohibiting unlawful employment discrimination.  Discrimination based on the race, religion,   color, sex (including pregnancy, gender identit y, and sexual orientation), parental status, national origin, age, disability, family medical history or genetic information, or any other non-merit based factor, is illegal and will not be tolerated.  Employees are also protected against retaliation or reprisal.  Retaliation against an employee who engages in a protected activity, whistle blowing, or the exercise of any appeal or grievance right provided  by law  is not  acceptable.

Individuals who believe they have been discriminated against must know they can freely exercise their right to file an Equal Emp loyment Opportunity (EEO) complaint or otherwise oppose unlawful discrimination, without fear of retaliation.

I'd also like to remind employees that I will not tolerate any form of discriminatory harassment, even when the behavior does not rise to the leve l of a violation of federal law. Employees must feel free to report harassment or assist in any harassment inquiry without the fear of reprisal.
Managers and supervisors must promptly report and correct harassing conduct in the workplace, as well as protect those who report it.   Fisca l Service employees are also reminded of their duty to avoid harassing behavior and to also report such conduct.  If you believe you are being harassed or have witnessed someone else being harassed, you should report it to your immediate supervisor, the EEOD Director at (304) 480-6527, or the Workforce Relations Branch at (304) 480-6565.

I expect every manager and supervisor to demonstrate active leadership in fostering a positive work environment that is free of discrimination. I believe the same level of commitment, effort, and teamwork, which has brought us success in the past with our high q ualit y services and products, is also needed to achieve our EEO objectives and affirmative employment initiatives. Therefore, I ask each of you to take responsibility for knowing our equal employment policies and cooperating fully in their implementation. It is essential that we continue to cultivate and foster a workplace culture of excellence that is inclusive and supportive of diversity, and safe and free from hostility or harassment. In such a workplace, we embrace our differences; everyone is treated with dignity and respect, and everyone has the freedom to compete on a fair and level playing field.

EEO Complaint Procedures & Contacts

As a federal employee or applicant for employment, you are protected against discrimination based on your race, sex, national origin, color, religion, age and physical or mental disability.  Retaliation for action taken to oppose or remedy discrimination is also prohibited. Certain Executive Orders also provide protection against discrimination based on sexual orientation, parental status, and protected genetic information.

If you feel you have been discriminated against, you MUST contact the EEO Office within 45 calendar days of the date of the incident that gave rise to your complaint, the date you became aware of the incident, or, if a personnel action, within 45 calendar days of its effective date or your knowledge of the action.

The Counselor will advise you of your right to elect between participation in traditional counseling activities or in the Alternative Dispute Resolution (ADR) process. During traditional counseling, the Counselor has 30 calendar days from the time you report your problem to attempt an informal resolution of the matter. If, at the end of this time, the problem is not resolved, you will be advised, in writing, of your right to file a formal complaint. The 30-day period may be extended to an additional 60 if YOU agree in WRITING to such an extension.

Should you elect to participate in ADR resolution, traditional counseling will not be attempted. Agencies have 90 days to conduct ADR during the pre-complaint process. If, at the end of this time, the problem is not resolved, you will be advised, in writing, of your right to file a formal complaint.

Reasonable Accommodation Policy
